Terms of Service — OptiPeak

These Terms of Service (“Terms”) govern your access to and use of OptiPeak (the “Service”), provided by Kevin Terrier, a sole trader established in France (“we”, “us”). By creating an account or subscribing you agree to these Terms.

1. The service

OptiPeak is an online AI coaching platform. It generates personalised training programmes, nutrition guidance, form-check analyses and event-preparation protocols using large language models. The Service is not medical advice and does not replace a qualified physician, physiotherapist, or dietitian.

2. Eligibility

You must be at least 15 years old and legally capable of entering into a contract. If you are between 15 and 18 you confirm that a parent or legal guardian has authorised your use of the Service.

3. Subscription plans & billing

Bronze Coach — €10 / month
Silver Coach — €15 / month
Gold Coach — €20 / month

Prices are in EUR and include applicable VAT. Payments are processed by Stripe. Subscriptions renew automatically each month until cancelled. You can cancel at any time from the in-app Manage billing portal; cancellation takes effect at the end of the current billing period. No pro-rata refunds are issued for the unused portion of a period once the digital service has been accessed.

4. Right of withdrawal (EU consumers)

Under Articles L221-18 and L221-28 of the French Consumer Code, you have a 14-day withdrawal right for distance contracts. However, by starting to use the Service immediately after subscribing (accessing your generated plan or AI coach), you expressly consent to the immediate performance of the Service and acknowledge that you waive your right of withdrawal once the Service has been fully provided.

5. Acceptable use

Do not upload media of anyone other than yourself without their consent.
Do not attempt to reverse-engineer, scrape or overload the Service.
Do not use the AI coach to obtain medical, legal or professional advice outside of general fitness guidance.
Do not share your account with others; each account is personal.

We may suspend or terminate accounts that breach these Terms.

6. Health & safety disclaimer

Training and nutrition carry inherent risks. You are solely responsible for assessing whether the guidance produced by the Service is safe and appropriate for you. Consult a healthcare professional before starting a new programme, especially if you have any injury, chronic condition, are pregnant, or are under 18. Discontinue any exercise that causes pain and seek medical attention as appropriate.

7. Intellectual property

The Service, including its interface, source code, prompts and branding, is the exclusive property of Kevin Terrier. AI-generated plans and coach responses are provided to you for personal, non-commercial use. You retain ownership of data you input; you grant us a limited licence to process it as needed to operate the Service.

8. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect or consequential damages such as loss of profits, data or performance. Nothing in these Terms excludes liability that cannot be excluded under French mandatory law.

9. Modifications

We may modify the Service or these Terms. Material changes will be notified in-app at least 30 days in advance. Continued use after the effective date constitutes acceptance.

10. Termination

You may terminate your account at any time. We may terminate or suspend access for material breach of these Terms, fraud, or if required by law. Upon termination your personal data is handled per the Privacy Policy.

11. Governing law & jurisdiction

These Terms are governed by French law. Consumer disputes may be brought before the courts of the consumer's place of residence within the European Union, or, alternatively, referred to a consumer mediator or to the European Commission Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
